1. GENERAL

1.1 These Terms of Service ("Terms") govern your use of the Frosted Affair website and your purchase of products from us.
1.2 "We," "us," and "our" refer to Frosted Affair.
1.3 "You" and "your" refer to the customer placing an order.
1.4 By placing an order, you confirm that you are at least 18 years old or have parental/guardian consent.

2. PRODUCTS AND ORDERS

2.1 All products are made to order and are subject to availability.
2.2 Product images are for illustration purposes. Handcrafted items may vary slightly in appearance.
2.3 We reserve the right to refuse or cancel any order at our discretion.
2.4 Order confirmation does not guarantee acceptance. Acceptance occurs when your order is dispatched.
2.5 Prices are in South African Rand (ZAR) and include VAT where applicable.

3. LEAD TIME AND DELIVERY

3.1 All orders require a minimum lead time of 5-7 days.
3.2 Orders placed without adequate lead time may be declined or subject to availability.
3.3 Delivery is available within Cape Town only.
3.4 Delivery is free for all orders within our delivery area.
3.5 You must be available to receive your order at the confirmed delivery time and address.
3.6 We are not responsible for failed deliveries due to incorrect address information or customer unavailability.

4. PAYMENT

4.1 Full payment is required at the time of order.
4.2 We accept payment methods as displayed at checkout.
4.3 All payments are processed securely through our payment provider.
4.4 Orders will not be processed until payment is received in full.

5. CANCELLATIONS AND MODIFICATIONS

5.1 Cancellations within 24 hours of order placement may be eligible for a full refund, provided production has not begun.
5.2 Cancellations after 24 hours or after production has commenced are not eligible for refunds.
5.3 Order modifications may be accommodated if requested at least 5 days before delivery, subject to availability.

6. NO RETURNS OR REFUNDS

6.1 Due to the perishable nature of our products, ALL SALES ARE FINAL.
6.2 We do not accept returns, exchanges, or provide refunds.

7. ALLERGENS AND DIETARY REQUIREMENTS

7.1 All products contain allergens including wheat (gluten), eggs, milk (dairy), corn, soy, and artificial colourants.
7.2 Products may contain traces of tree nuts, peanuts, and sesame.
7.3 Our products are not suitable for individuals with severe allergies.
7.4 By placing an order, you accept full responsibility for any allergic reactions.
7.5 We are unable to guarantee allergen-free products.

8. PRODUCT STORAGE AND CONSUMPTION

8.1 Products should be consumed on the day of delivery for best quality.
8.2 Store products in a cool, dry place away from direct sunlight.
8.3 Products with cream cheese frosting or fresh fillings should be refrigerated.
8.4 We are not responsible for product quality if storage guidelines are not followed.

9. INTELLECTUAL PROPERTY

9.1 All content on our website, including images, text, logos, and designs, is owned by Frosted Affair.
9.2 You may not reproduce, distribute, or use our content without written permission.

10. LIMITATION OF LIABILITY

10.1 To the fullest extent permitted by law, Frosted Affair shall not be liable for any indirect, incidental, special, or consequential damages.
10.2 Our total liability for any claim shall not exceed the amount paid for the specific order in question.
10.3 We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to weather, traffic, or supplier issues.

11. INDEMNIFICATION

11.1 You agree to indemnify and hold harmless Frosted Affair from any claims, damages, or expenses arising from your breach of these Terms or misuse of our products.

12. GOVERNING LAW

12.1 These Terms are governed by the laws of the Republic of South Africa.
12.2 Any disputes shall be resolved in the courts of the Western Cape, South Africa.

13. CHANGES TO TERMS

13.1 We reserve the right to update these Terms at any time.
13.2 Continued use of our website after changes constitutes acceptance of the updated Terms.
